This page explains how to submit a copyright takedown notice, or to challenge our “fair use” of copyrighted material, under the Digital Millennium Copyright Act (DMCA).
The DMCA was signed into law in 1998 and implements two World Intellectual Property Organization (WIPO) treaties — the WIPO Copyright Treaty and the WIPO Performances and Phonograms Treaty — alongside other copyright-related provisions.
Filing a Takedown Notice
If you are a copyright holder, or an agent authorized to act on a copyright holder’s behalf, and you believe that content on scienceaplus.com infringes your copyright and falls outside the bounds of “fair use”, please send us a written notice of infringement that includes:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material that is claimed to be infringing, and information reasonably sufficient to let us locate it (e.g. the URL of the page);
- Your contact information, including your address, telephone number, and email address;
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
Please send your notice to our designated contact: [email protected]. Upon receipt of a valid notice, we will respond and act expeditiously, which may include removing or disabling access to the material in question.
Counter-Notice
If you believe material you posted, or that we removed on your behalf, was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice to the same contact address above. Your counter-notice should include:
- Your physical or electronic signature;
- Identification of the material that was removed or disabled and its location before removal;
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts of Sri Lanka and will accept service of process from the person who filed the original notice (or their agent).
Upon receipt of a valid counter-notice, we may reinstate the material unless the original complainant informs us that they have filed legal action to restrain the alleged infringing activity.
